AV新法が藪蛇になったようで、同人AVを違法だという規制側の人が増えています。
違法でなく、違法にしたい、というのが本音です。そもそもかつて同人AVと言われたfc2無修正は
もう存在しない。今同人AVとしきりに言われているものはfans系の個撮AVもどきです。
fans系の売り上げが億を超え、配信者個人が億の売り上げを出したからです。

規制側というのは、適正AV側の人々ですが、適正AVと名付けた人権倫理機構が解散し
適正AVという呼称を使わせない、となったので、この残骸を放置したまま
適正AVを使う個人と、ルールにのっとった映像制作ネットワーク、なるものを
グズグズと規定している審査団体系（人権倫理機構と喧嘩別れした模様）の団体が
同人AVは、自分たちの決めたルールにのっとっていないから違法AVだ
と言いたいようなのです。

同人AVは非合法（だろう）！AV新法も守っていない（だろう）、なんだかわからない！
というわけです。

もともとはFC2の無修正や丸見え同然のうすけしを同人AVと言っていたのですが、
AV新法以降、海外系のFC2はみんな摘発されてしまったし
創設者も逮捕されてしまいまして、FC2の非合法AVはもうないか
ほとんど息をしていない、ましてAV新法違反というのがあるかというと
実績は契約書を交わしていない（契約書の書き方がわからなかった）
位の話なので、素人がうっかりAVのようなものに手を出した、というケース
今はほとんど聞かない。
変わってコロナの時に始まった個人配信が、エロ系になり、
AV新法で自分で自分を配信する分には契約書は必要ない
（大家さんが自分で借り手を探して部屋を貸すのと一緒。つまりAV新法は宅建業法のコピー）
ことから、マスク女がオナニーを配信したり、からみもどきを配信したり
ポーンハーバーから始まったのですが、彼らのカップル配信が無修正だったり
国立公園だったりで大きく問題になって摘発を受けた。

このあたりのAVを違法な同人AVと呼ぶならいいのですが
fantiaや○○fansのモザイクが入った個撮AVを違法な同人AVと呼びたそうな
旧適正側の言い分は、どうにもまとまりがない。
それは
A：男優系の団体（男優の仕事が増えるよう新法を変えたい）
B：SODなどのメーカー系団体（プロにまで適用するのを変えたい）
C：女優系の集団（よくわからないけど適正であれば仕事も増えて儲かるはずだ）
D：旧適正AVを標榜した某メーカー運営の規制団体（男優女優メーカー販路販売もすべて独占したい）

彼らの共通の敵として、同人AVという言葉を違法なものとして都合よく使っているに過ぎない

てんでんばらばら腹の底は真っ黒け、な人々が○○の会、をそれぞれ作って陳情に走っています。
議員は相手にしてないようですが
逆に着衣か非商業撮影、ならなんでもいい、という風潮になってしまい
AV新法という法律の悪影響が日々SNSで拡散されています。

だれでもTフロント自撮りを配信し、キャバ嬢や風俗嬢が一攫千金大富豪を喧伝し
港区女子の売春や閉鎖空間での乱痴気騒ぎをSNSにアップされ、と
商業エロ映像でないところがどんどん荒れています。

と言って商業AVの未来は今のとこ真っ暗なので
独占体制が日々進んでいます。女優も男優もメーカーも登録しないと作らせない。
これも黒幕の寿命が近いので
変化するかもしれない。
そんな窮屈な業界より、マイペースで気持ちよく稼ぎたい、という人たちの
受け皿がfansAVで、これをAVと呼ぶのは無理がある。
いいところ3Pまでであろうと。
クレカも少しづつ改善の兆しがあるが、条件が悪いので折り合わない
ただし進んでいる。
クレカが復旧してももはや撮れないかもしれないし

あんまり意欲的になれない業界ではあります。

で、今同人AVと言われているものは、結局非合法でなく
個人なのに億を超えるほどの売り上げを挙げる
適正AVにとって独占できない、見逃せない分野になってきたので
なんとか潰したい。という腹黒さが出ているだけと思っています。

とにかく醜い。
ゲロより気持ち悪いので私はあまりこの話題にかかわりたくないが
あまりにも誤解を巻き込んだまま5つ巴で進んでいるので
ちゃんと理解する読み物くらいはあってもいいだろうと思い
一つの俯瞰として書いています。

男優女優メーカー規制団体、それぞれが勝手に理屈を並べていますが
議員に陳情するのに同人AVという我々とは異質な非合法のAV、というのを作らないと
陳情できないからでしょうか
それでも日々fans系はできています。4つか5つくらいあるでしょう。

モザイクが薄いのかはわからないですが、オフィスのタイルカーペットと化した
適正AVよりは薄いと思います（苦笑

適正側も大きな顔をしている割には本番がもはや、いつ禁止になるかわからない状態
人数ものは新法でほぼ無理
100人、200人という意欲的なタイトルは作れたとしても驚きとか話題性がない。
店舗の行列もめっきり音沙汰がなくなった
そこにホルムズやAi革命やインフレが来ている
一部のマニアックなものは数字があるけど
今から新しいマニアックなAVが意欲的に出てくるかというと、
まず難しい。
出てくるのはfansAVだったという。

で、fansAVが商業AVになることはほとんどない。
商業AVがルールが厳しすぎてfansAVやFC2、Dugaに来る流れはある。
fansAVが商業化するには、複数出演者は必要
ここでAV新法の問題が出る。2,3人なら何とかなっても
違うキャストが毎月出てくる、となると大変だ。
fansAVは女優か男優が固定なので、女優を変えようとすると
長期的にはプロダクションと付き合わないといけない。
プロダクションは適正AV登録しないと出さない。まして新規の取引はしない。
ギルドから外れたプロダクションがあるかどうか、わからない。
それこそ同人プロダクションになる。

運よくプロダクションと付き合いができたとして、プラットフォーム系でやるのか
独自販路を作るか、凍結対策をどうするか、が出てくる
今のfans系はここをやらない。億の売り上げがあるなら簡単だと思うけれど。
今は決済代行が軒並み決済停止を食らっているから、営業しないのもある。
それならonlyfansとか海外プラットフォームで海外撮影で無修正で、と考える人もいる
ただOnlyfansやpornhubでの海外無修正は今は見ない。

独自販路をやるなら風営法届け出が必要で、これもある程度金がかかる。
事務所を持っているくらいならできるだろうけど、その先の独自販路が
今決済停止の嵐で開けないから、めんどうだからfansでいいや、となってる。

このゆるふわなマイペースエロを、違法同人AVとして
適正AVの反対で悪質だから調査して規制しろ、と
規制されている適正AV側がいうのは
そもそもAVが悪質な強要やネット露出でリベンジポルノ的な問題をはらんでいて
第三者の性行為を映像販売することが最も問題だ、という
AV新法の根底に流れる国の考えに沿っているか、
”おまゆう”と言われて正当化できそうにない
と私個人は思うわけで。

百歩譲って、プロが毎回契約書を1-4ルールでかわすのは
確かに問題あるよね。と思います。
エキストラ男優や女優（脱ぐだけ）にまで契約を強要するのもおかしいと。

なのでSODさんの改正案は具体化しているから
一番進んではいるが
新法の全会一致を言い出した人が今選挙で大勝利をして
トランプと仲良しの総理大臣をやっているものですから
この法律が見直されるにはよほど議員側の同情を得ないと難しいし
フィクサーがまだ存命なので、全力で止めてくるだろうと。

そう考えると、インディーズAVがマンションで売られていた95年や
ネットがADSLになって海外のAVが見られるようになった2000年
カリビアンコムが席巻した2007年の時のような
エロい熱気というのが感じられないもので

なんか窮屈なだけでエロじゃないほうがいいかなと思い
Aiをいろいろ試しているという感じ。
Aiも動画や画像はすぐに問題になるから、
テキストやエージェント型になっていく流れ。
ただしAiはほぼ3か月スパンでモデルが進化しているので
数年以内になにかが起こる、のは間違いない状態ではあります。
それがエロAVなのか、逆に動画視聴のままなのかは、わからない。
とにかく事務職がまるごとなくなりそうな勢いなので
どんな地殻変動が起こるかわからないから
AVの進化どころではないかもしれない。
電気保安はまったく人が足らない
宅建もそうですが、実務者経験が必要なので
どこも欲しいのは30歳までの人たち。
その人たちは120万人>100万人＞70万人とおよそ7年ごとに減っているうえ
すさまじくひ弱で働きたがらない人々だから
およそ使い物にならない
つまりどっちを向いても八方ふさがりであります。

The new AV law has stirred up a hornet’s nest, and more people on the regulatory side are now claiming that
doujin AV(Onlyfans style porn) is illegal.
Their real intention is not that it’s already illegal, but that they want to make it illegal.

Originally, what used to be called doujin AV—FC2 uncensored content—essentially no longer exists.
What people are now loudly calling “doujin AV” is basically fans-site-style pseudo-individual-shoot AV.

This is because fans-site creators’ sales have exceeded hundreds of millions of yen,
with individual distributors earning over 100 million yen.

The regulatory side consists of people from the “proper AV” camp. However, after the Japan Contents Review Center
(the human rights and ethics organization that coined the term “proper AV”) disbanded and
the name “proper AV” was no longer allowed to be used, the remnants of that group—along
with the censorship organization (which seems to have had a falling out with the human rights ethics body) that
vaguely defines things like the “Video Production Network that follows the rules”
—are trying to position doujin AV as the polar opposite: AV that does not follow the rules.

In short, they want to say:
“Dōjin AV is illegal, doesn’t comply with the new AV law, and is some kind of incomprehensible thing!”

Originally, FC2 uncensored videos or near-uncensored “thin mosaic” content were what people called doujin AV.
But after the new AV law, overseas FC2 operators were all cracked down on, and even the founder was arrested.
As a result, illegal FC2 AV has basically disappeared or is barely breathing.

Regarding violations of the new AV law, the only real issues were things like not having proper contracts
(because they didn’t know how to write them). Cases of amateurs carelessly stepping into
AV-like content are now almost unheard of.

Instead, personal streaming that began during the coronavirus period turned erotic. Under the new AV law,
if you stream yourself, you don’t need a contract (just like a landlord finding tenants themselves
—the new AV law is basically a copy of the Real Estate Brokerage Act).

This led to “mask girls” streaming masturbation, pseudo-sex acts, and content that started on Pornhub.
Their couple streams were often uncensored or shot in national parks,
which caused major problems and led to crackdowns.

It would be fine to call that kind of AV “illegal doujin AV,” but the old “proper AV” side’s argument
—that they want to label Fantia and ○○Fans-style individual-shoot AV with mosaics as “illegal doujin AV”—is
incoherent and all over the place.

They consist of:
A: Male performer groups (who want to change the law to increase work for male actors)
B: Manufacturer groups like SOD (who want to avoid having the rules applied to professional productions)
C: Female performer groups (unclear, but they probably think “proper” status will increase work and profits)
D: The regulatory organization run by a certain manufacturer that once championed “proper AV”
(wants to monopolize male/female performers, manufacturers, distribution, and sales channels)

They are simply using the term “doujin AV” as a convenient label for their common enemy, portraying it as something illegal.

These people, each with their own scattered agendas and pitch-black hearts, have formed various “○○ Associations”
and are rushing to petition lawmakers.

Lawmakers don’t seem to be engaging with them much, but the backlash has created a trend where “as long as
it’s clothed or non-commercial shooting, anything goes.”
The negative effects of the new AV law are spreading daily on SNS.

Anyone can stream T-front selfies, cabaret girls and sex workers advertise getting rich quick,
and posts about Minato Ward women’s prostitution and wild orgies in closed spaces are all over SNS.
The non-commercial erotic video scene is getting increasingly chaotic.

Meanwhile, the future of commercial AV looks bleak right now, and monopolistic structures are advancing day by day.
Actresses, actors, and manufacturers must register or they can’t produce anything.

This too might change because the key puppet masters behind it are nearing the end of their lifespan.

Fans AV has become the outlet for people who want to earn money at their own pace
in a less restrictive way rather than in that suffocating industry. Calling this “AV” is already a stretch
—even if it goes up to 3P at best.

Credit card processing is slowly showing signs of improvement, but the conditions are still bad,
so many can’t reach an agreement. Still, progress is being made. Even if cards are restored,
it may already be too late for many to shoot.

It’s an industry that doesn’t inspire much enthusiasm.

In the end, what is now called “doujin AV” is not actually illegal. It’s simply a field where individuals can earn over
100 million yen—something the “proper AV” side cannot monopolize and cannot ignore.
So they desperately want to crush it. That’s all this black-heartedness really is.

It’s all so ugly.

It’s more disgusting than vomit, so I don’t really want to get involved in this topic,
but because so much misunderstanding is being spread while five factions fight each other,
I thought it might be useful to have at least one readable overview.
This is my attempt at a bird’s-eye view.

Male performers, female performers, manufacturers, and regulatory groups are all making up their own arguments.
But to petition lawmakers, they apparently need to create the image of “doujin AV” as something alien
and illegal that is different from them.

Even so, fans-type content is still being produced every day. There are probably four or five major platforms.

I don’t know if the mosaics are thinner, but I think they’re thinner than the “proper AV” that
has become like office tile carpet (wry smile).

As for commercial AV, it’s unclear what will happen with real sex scenes—they could be banned at any time.
Group shoots with many people are almost impossible under the new law.
Even if they make ambitious titles with 100 or 200 people, there’s no longer any surprise or buzz.
Lines at stores have also completely disappeared.

On top of that, Hololive, the AI revolution, and inflation have arrived. Some niche genres still have numbers,
but it’s hard to imagine new ambitious niche AV coming out now.

What has come out instead is fans AV.

Fans AV almost never becomes commercial AV. There is a flow from commercial AV to fans AV, FC2, or Duga
because the rules are too strict.

To commercialize fans AV, multiple performers are needed. That’s where the new AV law problem appears.
With 2-3 people it might be manageable, but having different casts every month is extremely difficult.

Fans AV usually has fixed actresses or actors, so if you want to change the actress, you eventually
have to work with a production company.
Production companies won’t send talent unless they are registered as proper AV, and they especially won’t do new deals.
It’s unclear if there are any production companies outside the guild. That would essentially be a doujin production.

Even if you manage to partner with a production company, questions arise: do you use a platform,
create your own sales channels, or how do you handle account freezing?
Current fans creators aren’t doing any of that. If they’re earning hundreds of millions, it should be easy,
but many aren’t operating because payment processors are shutting them down one after another.

Some are thinking of shooting uncensored overseas on OnlyFans or Pornhub,
but you don’t really see overseas uncensored content on OnlyFans or Pornhub these days.

If doing your own sales channels, you need a fuzoku (entertainment business) notification, which also costs money.
If you have an office, it’s doable, but with the current storm of payment stops, opening your own channels is difficult.
So many just think “fans is fine.”

The “proper AV” side calling this loose, relaxed, personal-pace erotic content “illegal doujin AV” and
demanding investigations and regulation because it’s “malicious” is, in my personal opinion,
something that cannot be justified under the fundamental philosophy of the new AV law
—that AV inherently involves coercive acts, revenge porn risks,
and that third-party sex acts being sold as video is the biggest problem.

A hundred steps back, I do think it’s problematic that pros have to exchange contracts under
the 1-4 rules every single time. Forcing contracts even on extra male performers or actresses
who only undress is also strange.

So SOD’s proposed amendments are the most concrete and advanced.

However, the person who pushed for unanimous passage of the new law is now
the Prime Minister after a landslide election victory and is close to Trump,
so revising this law will be very difficult without gaining significant sympathy from lawmakers.
The fixers are still alive and will block it with full force.

When I think about it, the erotic heat of the 1995 era when indie AV was sold in apartments,
the 2000 era when ADSL arrived and overseas AV became accessible,
or the 2007 Caribbeancom dominance period is completely gone.

It feels so restrictive that I sometimes think non-erotic might be better, so I’ve been experimenting with AI.

AI videos and images quickly run into problems, so the trend is moving toward text and agent-type content. Still,
AI models evolve roughly every three months, so something big will definitely happen within a few years.
Whether that becomes erotic AV or stays as video viewing is unknown.

At any rate, white-collar jobs as a whole are on the verge of disappearing, so massive tectonic shifts are coming.
AV evolution might not even be the main event.

There is a severe shortage of people in electrical safety, real estate brokerage, etc.,
but they all require practical experience, so they only want people up to 30 years old.
Those age groups are shrinking dramatically (1.2 million → 1 million → 700,000 roughly every 7 years),
and they are extremely fragile and unwilling to work, so they are mostly unusable.

No matter which way you look, it’s a dead end.
